U.S. District Judge Henry Wingate, of the Southern District of Mississippi, has been named the recipient of the Dishonorable Judicial Conduct Award for October due to his reckless and misleading conduct in a case involving Mississippi’s anti-DEI education law. The case, Jackson Federation of Teachers v. Fitch, saw Wingate issue a temporary restraining order (TRO) and a preliminary injunction that were filled with fabricated facts, misleading legal interpretations, and outright falsehoods, ultimately leading to his removal from the case by the Fifth Circuit Court of Appeals.

A Case Built on Fabricated Facts

The lawsuit, brought by a group of teachers, professors, students, parents, and activist organizations, claimed that Mississippi’s 2025 anti-DEI law violated the First Amendment. The law, which prohibits educational institutions from mandating DEI programs, punishing students for their opinions on DEI, endorsing DEI in course materials, and circumventing the law, was challenged by the plaintiffs as an unconstitutional overreach. However, the judicial proceedings were marred by Wingate’s egregious missteps.

In a TRO issued by Wingate, the judge included numerous factual assertions that had no basis in the record or the case. These included references to eleven plaintiffs and two defendants not named in the complaint, supposed declarations from four non-existent or never-present individuals, false quotations from the law, and erroneous claims that the law had already led to the demise of fictitious DEI programs at three different colleges. Wingate even falsely claimed that staff at one school had been told not to discuss certain topics, such as historical interpretations of systematic racism.

After Mississippi pointed out the errors, Wingate attempted to blame his law clerk for using an AI program to draft the order. He replaced the flawed TRO with a “corrected” version, which he removed from the case file and denied restoring to the official court docket. However, the Fifth Circuit found that the “corrected” TRO still contained hallucinated information, including a citation to a non-existent Fourth Circuit decision. The court thanked the state of Mississippi for providing a copy of the original TRO, as Wingate had kept it from public view.

Legal Misconduct and Judicial Overreach

Wingate then proceeded to issue a preliminary injunction incorporating the still flawed “corrected” TRO. The Fifth Circuit noted that he had “the entire law of injunctive relief completely backwards.” The court criticized Wingate for not only misapplying legal standards but also for ignoring or circumventing relevant precedents in favor of subjective interpretations, such as what one witness wondered or what one parent thought could be considered by Mississippi in enforcing the law.

According to the Fifth Circuit, Wingate’s actions were driven by a desire to stop the state’s anti-DEI law, leading him to “carelessly exercise his Article III power by issuing sloppy edicts based on falsehoods and fabrications.” Once the falsehoods were exposed, Wingate refused to acknowledge his mistakes, claiming that the hallucinated claims had no bearing on his reasoning and offering no explanation for including such irrelevant material in the original TRO.

Severe Consequences for Judicial Misconduct

The Fifth Circuit’s panel concluded that Wingate’s conduct was so egregious that it warranted not only the reversal of his injunction but also a reassignment of the case to a different judge. The court instructed the chief judge of the Southern District of Mississippi to assign the case to a new judge and to conduct proceedings “consistent with federal law as interpreted by the Supreme Court and this circuit.”

This decision marks a rare and severe consequence for judicial misconduct, as the Fifth Circuit noted that such actions are “one almost never sees in the federal judicial system.” The court’s decision underscores the importance of judicial integrity and the necessity for judges to adhere to legal standards and factual accuracy in their rulings.

Broader Implications for Judicial Accountability

Wingate’s case highlights the broader issue of judicial accountability and the potential consequences of misconduct in the federal judiciary. The Fifth Circuit’s intervention serves as a reminder that federal judges are expected to uphold the rule of law and ensure that their decisions are grounded in fact and precedent, rather than personal or political agendas. The case also raises questions about the oversight mechanisms in place to prevent such misconduct and ensure that the judiciary remains a pillar of impartial justice.

As the Fifth Circuit’s decision underscores, the judicial system must maintain its integrity and ensure that its members are held to the highest standards of conduct. Wingate’s actions not only undermined the legal process but also risked eroding public trust in the judiciary. His case serves as a cautionary tale about the consequences of judicial overreach and the importance of upholding the principles of fairness and accuracy in the courtroom.
