A federal judge appointed by former President Barack Obama ruled Monday that the Justice Department under President Donald Trump illegally fired Maurene Comey, the daughter of former FBI Director James Comey. Judge Jesse Furman, confirmed by the Senate in 2012, declared the administration’s actions unlawful and ordered Comey to be reinstated with back pay.
Constitutional Balance at Stake
Furman argued that the Trump administration’s claim that Article II of the U.S. Constitution allows the Justice Department to remove assistant U.S. attorneys without congressional oversight contradicts nearly two centuries of Supreme Court precedent. The judge warned that if the administration’s argument were accepted, it would undermine the constitutional balance of power and risk a return to the ‘spoils system’ that Congress has sought to eliminate since the 19th century.
CSRA Limits DOJ Authority
Furman emphasized that while the Attorney General has broad authority to remove assistant U.S. attorneys, Congress has imposed limits through the Civil Service Reform Act (CSRA). He stated that Comey’s termination violated the CSRA, as she was not fired for cause or performance, and the administration failed to provide advance notice or an opportunity to respond.
DOJ to Appeal Decision
A DOJ spokesperson confirmed that the administration plans to appeal Furman’s ruling but has not yet set a timeline for the appeal. Comey, who previously worked as an assistant U.S. attorney in the Southern District of New York, had prosecuted high-profile cases, including those involving the late convicted pedophile Jeffrey Epstein.
